Bobby Cutts Jr. Rightfully Gets 57 Years in Prison

Bobby Cutts Jr., 30, was sentenced to life in prison without parole for 57 years. He had faced a possible death sentence for murdering Jessie Davis and her unborn child, who was to be named Chloe.

"Bobby Cutts took my sister from me. You took a chunk out of my heart," Stephanie Davis said, reading from a letter she read for her cousin, Caylon Davis, Jessie's adopted brother, at a hearing before Stark County Common Pleas Judge Charles Brown Jr.

The African American former Ohio police officer was sentenced today after a jury voted to spare his life. Cutts, who appeared to choke up at times during his sentencing, did not speak. During a hearing earlier this week, he pleaded for his life, telling the jury in a quivering voice that he accepted responsibility for his crimes. "Ladies and gentlemen of the jury, I'm asking you to spare my life," Cutts said.

Cutts cried on the witness stand during his trial as he said he accidentally killed Jessie Davis by elbowing her in the throat during an argument. He hid her body in a park, finally leading police to her body after a nine-day search that generated national attention.

A jury convicted Cutts of murder for Davis' death and of aggravated murder for the death of her fetus. Cutts told the jury that he swung his elbow at Davis during a confrontation in her bedroom when she refused to allow him to leave her home. The blow to her throat, which he testified happened after she bit his finger, knocked her back, killing her as their 2-year-old son, Blake, slept, he said.

Davis' sister, Whitney Davis, said Cutts' only regret was getting caught. "When I hear Blake cry, I hate you," she said at today's sentencing. "You have not lost someone. You got rid of someone who was an inconvenience for you" When police arrived at Davis' condo, they found Blake alone. Police said he told them, "Mommy's in the rug."

Cutts, who as a cop had emergency response training, said he performed CPR and then searched for rubbing alcohol to use as a smelling salt to revive the woman. When he couldn't find any, he said, he retrieved a bleach container and tried bleach, knocking the container over and spilling bleach on the floor. Davis did not respond.

"This can't be happening," Cutts recalled thinking as he wrapped her body in a comforter. "This is not real. This is a bad dream."

Yeah, He Did It!

An Ohio jury has found Bobby Cutts Jr., a former Canton police officer accused in the June 14 killing of his pregnant lover Jessie Marie Davis and their unborn child, guilty as charged.

After more than 20 hours of deliberations, the jury found Cutts guilty of a number of crimes including murder, aggravated burglary, child endangering and abuse of a corpse. He was found not guilty of the greater charge of aggravated murder, however.

The 30-year-old Cutts admitted killing the 26-year-old Davis, but insisted her death was an accident. However, prosecutors dismissed this as a calculated lie, saying he deliberately killed Davis to avoid paying child support, and then dumped her body in a nearby park.

To the sound of loud gasps that echoed inside the Canton courtroom, Bobby Cutts Jr took the stand today and proceded to tell jurors on Monday between tearless sobs that he realized that his pregnant girlfriend was dead when he couldn't find her pulse after she suffered a blow to her throat.

"I didn't mean to hurt her," the African American former police officer said on the witness stand about Jessie Davis, who was nine months pregnant with his second child when she died last June.

Cutts, 30, testified that during an argument at her home, he pulled his arm away and threw his elbow back, landing on her throat. Davis fell down, Cutts said. Cutts was at Davis' home to pick up their 2-year-old son and was rushing her so he could leave. Davis grabbed him and told him he couldn't leave, which is when he said he pulled his arm away and struck her.

After several attempts to revive Davis with CPR, Cutts said he went to their 2-year-old child's room to get bleach to try to bring her to because he thought she was just knocked out. "I got the bleach and took it back to the room and tried to put it under her nose," Cutts said, adding that it didn't work. "She wasn't responding, I tapped her and she was dead," Cutts said.

He then decided to leave the home and take Davis with him. Cutts said he loaded her body in a comforter into the bed of his truck and called Myisha Ferrell, a friend, for help. "I decided to leave, I didn't know what to think," Cutts said. "How in the hell am I going to explain this?" Cutts said.

Cutts, continuing to cry on the stand with tissues in his hands, said he was thinking at the time "this is not real, this is not real, it could not be happening. This is a bad dream."

Cutts could receive the death penalty if convicted of killing Davis.

A medical examiner testified last week that the rate of decomposition from nine days of exposure in the summer heat made it impossible to determine how Davis died. The move for Cutts to take the stand surprised the courtroom, causing a gasp when lead defense attorney Fernando Mack called his client to the stand.

Prosecutors say Cutts went to her home late last summer, strangled her, then wrapped her body in a comforter, put it in the back of his truck and dumped it in a field of tall grass. And they didn't hold back in cross-examining who they believe is a callous, cold-blooded murderer now looking to escape the very justice he once upheld.

Defense attorneys told the jury during opening statements that no such evidence existed and prosecutors warned that common sense, not DNA evidence, would determine the case.

Prosecutors are relying on eyewitness testimony and circumstantial evidence in their attempt to prove that Cutts killed Davis, who was pregnant with his daughter.

Summit County Medical Examiner Lisa Kohler told jurors that it was possible Davis was strangled but she could not make a definitive ruling. She ruled Davis' manner of death as unspecified homicidal violence.

The case's key witness, Cutts' longtime friend Ferrell, testified that Cutts demonstrated to her that he choked Davis with his arm.Defense attorneys have not challenged Ferrell's testimony that she witnessed Cutts dumping the body in a park about 20 miles from Davis' northeast Ohio home.

Jurors also heard from another of Cutts' friends, Richard Mitchell, who said Cutts threatened to kill Davis and throw her body into the woods about a month before she disappeared. Mitchell added that he believed Cutts was joking.

Several of Cutts' former lovers, all of whom are white, testified that Cutts had never been violent with them and was a good father. Ex-wife Kelly Schaub, also white, testified that she believed Davis, who once left her underwear in Schaub's makeup drawer, was trying to destroy her marriage.

Prosecutors have said Cutts was feeling the pressure of his crumbling marriage, financial debt and supporting several children.

Testimony Asserts That Cutts Had Body In Back Of Pickup Truck

A longtime friend of a former Black police officer charged with murder testified Tuesday that the defendant picked her up in his truck one morning and told her the body of his young son's pregnant mother, Jesse Marie Davis, was in the back.

Myisha Ferrell said that she went with Bobby Cutts Jr. to a park where he dumped Jessie Marie Davis' body and that he coached her on what to tell investigators later. Her voice shook when she testified about what she saw as Cutts took out the body, which was wrapped in a blanket. "Her feet," she said. "I didn't want to see nothing else."

Ferrell is a key witness against Cutts, who could face the death penalty if convicted of aggravated murder. Prosecutors say Cutts, who was feeling the pressure of his crumbling marriage, financial debt and supporting several children, strangled Davis in her home and disposed of her body with Ferrell. The 2-year-old son Cutts had with Davis was found home alone.

Cutts led investigators to Davis' body, but the defense says he had nothing to do with her death.

Cutts, 30, a former Canton, Ohio patrolman, has pleaded not guilty to aggravated murder, aggravated burglary and other charges in the death of Davis and her female fetus. Thousands searched for Davis near her northeast Ohio home in the days she was missing after her June death.

Ferrell was sentenced to two years in prison after pleading guilty to lying to authorities and complicity to gross abuse of a corpse.

She testified Tuesday that she had drunk alcohol and smoked marijuana all night before Cutts showed up at her house after 6 a.m. June 14. Cutts looked nervous that day, like she'd never seen him before, she said.

After Cutts told Ferrell the body was in his truck bed, she asked him what happened. "He just said he kind of used his arm," said Ferrell, then held up her right arm at the level of her neck, re-enacting what Cutts demonstrated for her. Ferrell testified that after Cutts dumped Davis' body, he dumped two garbage bags in a trash bin. She didn't know where.

"What were you doing?" prosecutor Dennis Barr asked.

"Trying to stay sane," Ferrell said.

Cutts called Davis' cell phone at 7:11 that morning, according to phone records. Davis' cell phone was missing from her home, and investigators have not been able to find it. Ferrell testified that she threw a pink cell phone out a window, but that she didn't know whose phone it was.

Cutts stopped at a gas station to buy mulch. Their next stop was his house, where he showered to get ready for football practice at the local high school, where he was an assistant coach.

Later, when investigators wanted to interview her, she said, Cutts told her what to tell them.
"He told me just tell him that I was going to baby-sit his son, and his mom never showed up to drop him off," she said.

Cutts left Hawthorne's home about four hours before he picked up Ferrell the morning of June 14. He had never been abusive with her and did not appear to be angry that night, Hawthorne said. Earlier Tuesday, Cutts removed his glasses and wiped his eyes when jurors looked at crime scene photos, including one of Davis' barely recognizable corpse.

Davis' sister, Whitney Davis, left the courtroom after prosecutors displayed the photos on courtroom monitors.

Black Ohio Police Officer Bobby Cutts Now On Trial, Accused Of Killing His Pregnant White Girlfriend Jesse Davis

MURDERER?

A crumbling marriage. Debts. Child support payments. Two pregnant White girlfriends. Bobby Cutts Jr. was a brotha under pressure. According to the prosecution, that pressure led to this former Canton, Ohio police officer choking 26-year-old Jessie M. Davis to death last June in an outrageous case that led to explosive racial discussions about Black men, white women, and the complete breakdown of human decency.

“We are here because of physical pressure,” Hartnett told a Stark County jury as Cutts’ trial began yesterday. “The physical pressure he exerted around the neck of Jessie Davis for the several minutes that it took for him to snuff the life from her and her unborn child.”

Then Cutts dumped her body in Hampton Hills Metro Park in Summit County and tried to lie his way out of trouble before directing investigators to her rotting body after a nine-day search, Hartnett said. The defense says there’s no proof that Cutts committed crimes that could result in a death sentence.

Prosecutors want to talk about Cutts the womanizer. The liar. The cheater. They want to show the pictures of Davis’ decomposed body. They want to talk about how Cutts knew where her body was and how Blake, the young son of Cutts and Davis, was left home alone for a day and a half.

Five witnesses took the stand Monday. The testimony centered on June 15, the day Davis’ mother, Patty Porter, reported her missing. Porter, her daughter Audrey Davis, Jessie’s neighbor and two sheriff’s deputies recounted the condition of Jessie’s Lake Township duplex.
The unlocked back door. Jessie’s 2-year-old son left alone, his diaper reeking. Her purse dumped on the floor. The comforter missing from her bed. The toppled stand and lamp. The open bottle of bleach and stained carpet.

When Stark County Sheriff’s Sgt. Eric Weisburn arrived at the house, Cutts was already there. Audrey had called him. He was still dressed in his Canton police uniform and had helped another deputy search the trunk of Jessie’s car. Weisburn taped two interviews with Cutts that day. The investigator also talked to Blake.

As Weisburn and the 2-year-old colored with crayons, Blake repeated three phrases: “Mommy’s crying. Mommy’s in the rug. Mommy broke the table,” Weisburn recalled. Later, Blake looked out the window and saw his father. “Daddy’s mad,” Blake said.

Weisburn asked why. The boy didn’t give a reason. He went back to coloring. Speaking to Cutts, Weisburn asked for a timeline of the last few days. When had he last talked to Jessie?
Cutts said they spoke on the phone on the night of June 13, after he played a softball game, according to a tape of the interview. She was supposed to take Blake by his house the next morning. After the softball game, Cutts said he went to a bar, then home. The next morning he picked up Ferrell, who was going to baby-sit Blake, and took her to his house. Jessie never came by.

When he called her at 7:11 a.m. on June 14, the cell phone went straight to voice mail. He left a message asking why she hadn’t told him she wouldn’t be dropping Blake off, he told Weisburn, according to the tape. Later that morning, Cutts went to GlenOak High where he helped coach football. He went to the bank regarding a loan. He picked up his daughter, went to Wal-Mart and did some mulching. That evening he coached a summer league basketball game. Then he took a nap and worked the night shift.

What was his relationship with Jessie Davis? Weisburn asked. Their relationship went back about four years. They had a son together. Cutts said he wasn’t sure if the child Davis was carrying was his. She had been involved with two other guys, he told Weisburn on the tape.

As for his marriage, he and Kelly were separated. Their relationship went off and on. They argued about money and the amount of time he spent working. Kelly had talked about getting a dissolution. “Things don’t always work out,” Cutts said. How did his wife feel about Blake? Weisburn asked. She treated him like part of the family, Cutts said.

What was the future for him and Jessie? “As long as we’re both parents to Blake, that’s the most important thing,” Cutts replied on the tape. After the second interview, Weisburn went to Cutts’ Plain Township house to have a look around.

Other witnesses, including Ferrell, corroborated Cutts’ timeline. Meanwhile, tips piled up with the sheriff’s office. People called about finding cell phones, diapers, comforters, unusual smells in vacant houses. Deputies dug up at least two dogs putrefying in shallow graves. But as investigators started collecting phone records for Cutts, Davis and Ferrell, Weisburn said he started seeing discrepancies in Cutts’ story.

The trial is to continue this morning with testimony about those phone records, and Myisha L. Ferrell, who prosecutors say witnessed Cutts dump Davis’ body, will take the stand. For updates, go to the Cutts Trial Blog.

Bobby Cutts Jr., currently incarcerated on a $5 million dollar bond for the murder of a pregnant Ohio woman, will appear in court Friday morning to face murder charges.

The arraignment will spell out the exact details of the indictment, including two counts of aggravated murder against the unborn child believed to have been Cutts second child, and one count against Jessie Davis. Cutts could face the death penalty.


Canton Municipal Court Judge John Poulos had previously set bond for Myisha Ferrell, the high school friend said to have helped Cutts, at $500,000. She is also facing felony charges which include helping Cutts after the alleged murder occured.

As to how Jessie Davis was killed and determining a motive, authorities have yet to disclosed these additional details.

Before all the drama with Cutts, however, Shawn Kemp was known for (pick your favorite) drug problems, being overweight, fathering children, and being a pretty darn good basketball player back in the day.

Now his name has resurfaced in the media because of Nikki's thing for triffling brothers.

Just as we're hearing that Kelly Schaub Cutts (also white) is filing for divorce from Cutts, 30, we can't help but explore the connection that Cutts had with Kemp.

Reports are that after Bobby Cutts and Nikki Giavasis broke up, Cutts went to her apartment, but when she did not answer, Cutts then broke down the door.

Who was inside with Giavasis? Shawn Kemp.

Back in 2001, Nikki Giavasis admitted that Kemp was the father to her second child. Giavasis was interviewed by WEWS and stated, “"I could have cared less about his (Kemp) money, I loved him and he said he loved me," the White bikini model and actress was quoted as saying.

"Getting pregnant, I wouldn't say I regret it because I love my son and he deserves a good life." At that time, in 2001, Nikki was getting $2,500 a month from Kemp for child support, but wanted more...

Before Bobby L. Cutts Jr.’s court appearance Monday, fliers were slid underneath windshield wipers of nearby cars and handed out to those walking by.

“White ladies beware,” the fliers read, “once you go black, you might not come back!”

Six members of the Parma-based branch of the National Alliance, a separatist group that’s based in West Virginia, distributed hundreds of them downtown.

COURT BARS CUTTS FROM SEEING 9 YEAR-OLD DAUGHTER

With a crush of media and curious citizens on hand for a case that’s drawing national attention, the National Alliance used the opportunity to perform, in the words of the organization’s chairman, Erich Gliebe, a “public service.”

Below photos of Cutts, a black Canton police officer, and Jessie M. Davis, the pregnant white woman from Lake Township who Cutts is accused of murdering, the flier delves into the “dangers” of interracial relationships.

Included on the flier is a photo of O.J. Simpson with his arm around Nicole Brown Simpson.

Moniquec Conner, president of the Canton chapter of the NAACP, isn’t overly concerned. “Whoever was writing those fliers and doing that, it’s simply a sign of ignorance,” Conner said.
“We are in this together.”

But Conner said “considering all the hate fliers and the different things that are going on ... I’m concerned with the additional crime that this could lead to.

KELLY CUTTS HAS FILED FOR DIVORCE & IS REQUESTING SUPPORT FROM BOBBY CUTTS

Erich Gliebe, chairman of the National Alliance, said his group’s flier distribution will continue throughout the Cutts trial.

Gliebe said Davis “was uneducated to the dangers of interracial relationships,” and in an attempt to reduce what he said is a significant risk to white women, members of his organization will distribute “thousands and thousands” of the fliers in the Canton area “as long as the trial lasts and perhaps even beyond that.”

Conner said the way Patty Porter, Davis’ mother, is handling the situation has helped and will prevent Davis’ death from becoming a matter of race.

“I feel that if (Porter) was preaching hate, hate, hate, hate, it might become a different issue, but she’s not that kind of a woman,” Conner said. “I don’t see this case creating a racial war. What I do see is outsiders, just foolishness, attempting to create one.”

BOBBY CUTTS: IF ONLY JESSE MARIE DAVIS COULD HAVE TALKED TO NIKKI GIAVASIS

The Davis Family: "We do not want vengeance, we want justice!"

During Bobby Cutts' arraignment today for the murder of pregnant Ohio woman Jesse Davis, a man representing himself as Bobby's uncle was reportedly ticked.

While Black family members of Cutts, 30, and Myisha Ferrell, 29, were forced towards the back of the courtroom, the Davis family, mostly White, were seated front and center.

"What kind of Christian woman gets pregnant with two children by a man already married to another woman," the uncle was quoted as saying.

What would likely be 2 year-old Blake's great-uncle, Fox News reported that this man, refusing to give his name, also blurted out with contempt, "What kind of justice is this?"

Now keep in mind, Cutts was a police officer.

Is it us, or does this sound a little strange??? And how does former NBA baller Shawn Kemp fit into this whole thing with Cutts and L.A. model Nikki Giavasis?

At a news conference following the arraignment, Patti Porter said when she stood up to look her daughters boyfriend Bobby Cutts straight in the eye, "I wanted him to see us. I was disgusted and I wanted Bobby to see it. But I saw nothing in his eyes. They were blank."

Jesse's mother went on to say that when she and Cutts made eye contact, it felt like her entire life had prepared her for that moment.

Insisting on clearly the air about past media reports that she initially supported Cutts, Porter was quite transparent about where she was coming from.

"We prayed it was not him. that's my grandson's father. But I never said I supported Bobby Cutts."

Jesse's 20 year-old sister, Whitney Davis, chimed in with "everyone knows he did it."

As for the five million dollar bond, Porter stated she wish the judge had set it for ten million, with five million set for Myisha Ferrell. Ferrell's bond was ultimately set at $500,000.

Whitney Davis also provided a window into just how much others have been touched by her big sister's brutal slaying. She spoke about a married couple who actually gave their wedding rings to the family in a show of solidarity.

While she was still wearing the rings, it was announced that Davis would be soon returning them to the couple.

As for little Blake who was left alone after possibly seeing his mom killed, his grandmother indicated that he was doing as well as could be expected. "He calls her on an old cell phone and talks to her," Porter said.

Jesse's mother clearly wanted the world to know the toll of losing her daughter Jesse, 26, has taken on her family."This is an unbearable loss. No words can express the heartache."

Porter also spoke about how others were being impacted by the tragedy. "Everyone is devastated by this, his family and the other children as well."

Holding back tears, Porter continued. "Jesse was like a pink cashmere in a pile of trash, she did not fit into this scenario at all and what people are saying about her is just not true."

Giavasis never met Jesse but spoke very highly of her on MSNBC with Dan Adams. With her attorney next to her, she also indicated that a judge today dismissed Cutts's petition for custody of their daughter. Giavasis had been waiting eleven months for a decision granting her full custody of her child.

These are just some of the comments we have received concerning the Jesse Davis case.

BOND SET FOR CUTTS IN THE MURDER OF JESSIE DAVIS

Bond was just set for Bobby Cutts, Jr. for $5 Million in the murder of Jessie Davis and her unborn fetus which is believed he fathered.

The preliminary hearing to determine whether there is enough evidence to go to trial is scheduled for July 2, 2007.

Canton Municipal Court Judge John Poulos set bond for Myisha Ferrell, the high school friend said to have helped Cutts, at $500,000. She allegedly is facing a Class 3 felony filing of helping Cutts after the murder occured.

Ferrell's hearing will take place on the same day as Cutts at 2:00pm. Cutts' prelim is scheduled at 1:00PM.

(AP) - Bad dog! Charlie the black lab is in trouble, again, after driving his owner's car into the Pend Oreille River.

Coupled with the dog’s destructive habit of chewing on the family’s furniture, Wednesday’s incident brought Charlie’s damage toll into the thousands.

Luckily for Charlie, his owner has a sense of humor.
“He doesn’t know what he did,” said Mark Ewing, who watched as his Chevy Impala sank in the river.

Ewing had just returned home from picking up a pizza. As he walked to his home, Charlie jumped into the car through an open window and apparently knocked the vehicle into gear.

"He somehow got the car into neutral," Ewing said. "My car just went boom, down an incline and into the drink."

Ewing could only watch as his Chevy Impala sank into the river. No dummy, Charlie jumped out of the window as the car went downhill.

"There's nothing weirder than looking at your car cruising down your driveway when you're not in it and seeing your dog jump out and then watching your car go splash," Ewing said.

Actually, things got a little weirder when the tow truck driver showed up.

Before the driver dove into the water to hook the car up to his truck, he asked Ewing to hold his dentures.

"My car's in the drink, I've got dentures in my hand and this guy Keith from Clyde's Towing goes swimming," Ewing noted.
